Proposed Trail Closure and Property Vacation

Herriman City is reviewing a request to close and vacate a public trail connecting Arlinridge Drive to 13400 South near Rose Creek Estates Phases 7a and 7b.

The trail runs behind several residential properties and connects the neighborhood to 13400 South. Several adjacent property owners have requested that the City consider closing the trail and vacating the City-owned property. Concerns raised by those property owners have included privacy, security, loitering, trash, late-night activity, and motorized vehicle use on or near the trail.

No final decision has been made. Herriman City is gathering additional information as the City Council considers whether to move forward with the proposal. Any final decision would follow the applicable public process.

What is Being Considered?

The City is evaluating whether the public trail should remain open or be closed and vacated. “Vacating” the property means the City would no longer retain the property for public use. If the trail were vacated, the City-owned property could potentially be transferred to adjacent private property owners.

There are several possible outcomes, including:

  • The trail is closed and the property is divided between adjacent property owners on both sides of the trail

Herriman City is seeking more detailed input from adjacent property owners who may be directly affected by the possible trail closure and property vacation.

The survey asks whether affected property owners support or oppose the proposed trail closure and property vacation, as well as how they would view possible property division and cost scenarios if the proposal were approved.

Possible Property and Cost Considerations

If the trail were vacated, the City-owned property could potentially be divided in more than one way. One option could be to split the property down the middle, with a portion added to the properties on each side of the trail. Another option could be to transfer the property to owners on only one side of the trail.

Affected property owners may also be asked to participate financially in costs related to property line adjustments, County recording, trail removal, fence adjustments, landscaping changes, or other work needed to complete the vacation.
