Apply for a Permit
Solicitors who are not exempt under City code must obtain a permit before going door to door in Herriman.
Know the Rules
Review important rules about permits, hours, identification, posted signs, and conduct at residences.
Quick Summary
Most people going door to door in Herriman to sell goods or services must get a solicitor permit before they begin. Some individuals are exempt under City code, such as certain religious, political, or charitable advocates. Even when a permit is not required, people going door to door still must follow important rules, including respecting no soliciting signs, leaving when asked, and following time-of-day limits.
Solicitors are required to carry a Herriman City-issued permit with them while soliciting in city boundaries.
For Solicitors
Who needs a permit
If you plan to go door to door in Herriman to sell goods or services, seek orders, request contributions, or promote a commercial offer, you generally must get a solicitor permit before you begin.
Some people are exempt from registration under City code. Common examples include:
- People who were specifically invited to a residence before arriving
- People delivering goods or providing services that were already requested
- Certain people sharing religious or political messages
- Certain charitable representatives, including some student fundraising activities approved by a school
Even if you are exempt from registration, you still must follow City rules while going door to door.
How to apply
Unless you are exempt, you must submit a completed application and obtain a permit before soliciting in Herriman.
A completed application generally includes:
- A completed application form
- Proof of identity
- A BCI background check
- Required fee
- Required business and tax-related information
- Any other information required on the application
The application form will include more detail about the required documents and disclosures.
Temporary and annual permits
If a completed application is submitted and the required conditions are met, a temporary permit may be issued the same business day. This temporary permit allows door-to-door solicitation while the City completes its review.
A temporary permit expires after 25 calendar days, or sooner if an annual permit is issued or denied. If approved, the annual permit is valid for one year from the date the temporary permit was issued.
Rules solicitors must follow
- Carry the permit while soliciting
- Wear the City-issued identification badge prominently
- Immediately identify yourself and the purpose of your visit
- Check for and obey any no soliciting sign
- Leave immediately and peacefully if asked to leave
- Do not use false or misleading statements
- Do not imply that the City endorses you, your business, or your products or services
- Do not use a false name or alias
- Do not enter a residence without clear permission
- Do not touch anyone without consent
- Do not continue after someone clearly says they are not interested
- Do not solicit before 9:00 a.m. or after 9:00 p.m. Mountain Time unless you have prior permission from the resident
Buyer’s right to cancel
In a home solicitation sale, buyers may have a legal right to cancel within three business days, unless goods or services are requested without delay in an emergency. Solicitors must provide the required written cancellation notice when the law requires it.
Permit denial, suspension, or revocation
A permit may be denied, suspended, or revoked for reasons listed in City code. Examples include an incomplete application, failure to provide required documentation, nonpayment of fees, false information, certain disqualifying criminal or civil history, or substantiated violations of the code.
Applicants and registered solicitors have appeal rights under City code.
For Residents
Your rights at your home
Residents have the right to privacy and to decide whether to speak with someone at their home.
- Decline to speak with a solicitor
- Ask a solicitor to leave your property
- Post a no soliciting sign
- Report suspected violations or concerning behavior
No soliciting signs
A reasonably visible sign such as “No Soliciting,” “No Solicitors,” “No Salespersons,” or “No Trespassing” serves as notice that solicitation is not welcome.
If such a sign is posted, a solicitor or advocate covered by the code must not knock, ring the doorbell, or otherwise try to get the attention of someone at the residence for solicitation purposes.
What solicitors must do
Solicitors must check for no soliciting signs before approaching a home. If asked to leave, they must leave immediately and peacefully.
They also may not:
- Misrepresent who they are
- Use deceptive tactics to get someone to open the door
- Continue after being told no
- Enter a residence without permission
- Solicit outside the allowed hours
- Claim that a City permit means the City recommends or endorses them
Exemptions residents should know about
Some individuals may be exempt from the permit requirement under City code, such as certain religious, political, or charitable advocates. Even when exempt from registration, they still must follow the rules about conduct at residences, including respecting posted signs and leaving when asked.
If you feel unsafe or believe the code is being violated
If someone acts suspiciously, refuses to leave, ignores a posted sign, or makes you feel unsafe, contact the appropriate City department or law enforcement.
Important Note
A City permit does not mean the City endorses a solicitor, business, product, or service. This page is intended as a general summary for convenience. In the event of any difference between this page and City code, the City code controls.
